Coming to Canada for study. Do I need Custodian?

If you are an international student and planning to apply for a study permit, you may be required to submit a custodian form with your study visa application. Note all the provinces in Canada have the same age for a minor. Hence, you should be careful when you apply for your study visa application.

Below is the age of minor in Canada

  • Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, Saskatchewan – Age 18 Years
  • British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Yukon – Age 19 Years

Note that only PR or Citizen can be a custodian. Custodians will not be responsible for housing, food or fee. Custodian will be responsible for only emergencies.

Below are activities which are the responsibility of the Custodian

  • Maintaining ongoing and deliberate contact with the student;
  • Liaising and/or intervening with school officials and representatives ( mainly applicable for the student under 17 – going to schools)
  • Offering guidance in opening bank accounts, purchasing pre-paid cell phones;
  • Referrals to essential community services such as libraries, fitness clubs, etc.;
  • Assist in accessing immediate and/or ongoing medical services;
  • Monitoring overall mental, the physical and emotional well-being of the student;
  • Explaining local laws and regulations; and
  • Responding 24/7 to emergencies involving the student

Note that the above are the primary duties. However, a custodian may need to provide additional support to the student.

How to appoint Custodian:

  1. Fill the Custodian – Parent form and submit along with the application form

The two pages of the form look similar, but:

  • The first page needs to be signed by the Custodian and notarized (certified by a lawyer or notary) in Canada
  • The second page needs to be approved and signed by the parents or legal guardians of the minor child and notarized in their home country

Work Permit after completing studies in Canada?

Congratulations on completing your studies in Canada. We understand that “Post Graduation Work Permit” is a very critical next step towards your immigration goal.

In 2019, the Government of Canada extended the time to apply for the Post-Graduation Work Permit from 90 to 180 days (six months). The countdown starts from the day the student received a transcript and an official letter from the eligible DLI confirming that the requirements to complete the program of study are met. The applicant must demonstrate that he/she either holds a valid study permit, held a study permit, or were authorized to study in Canada.

Am I eligible to apply for Post Graduate Work Permit? To be eligible for a Post-Graduation Work Permit, an international student must:

  • Be 18 or older and have continuously studied full-time in Canada in a study program at least eight months long
  • have a document from your school (transcript, official letter, certificate, etc.) that confirms you completed and passed all your program requirements
  • apply for a work permit within 180 days of when it was confirmed that you completed your program; and
  • have held a valid study permit at some point during the 180 days before applying.

Who is not eligible to apply for Post Graduation Work Permit?

International students are ineligible to apply if they:

  • have previously been issued a post-graduation work permit
  • received funding from Global Affairs Canada (GAC)
  • participated in the Government of Canada Awards Program funded by GAC
  • completed the majority of the credits toward the completion of their program of study by distance learning
  • completed a program of education delivered by a non-Canadian institution located in Canada, regardless of the length of stay.
